In short
About these terms
These terms are an agreement between you and SME Paisa ("SME Paisa", "we", "us"). They apply when you sign up and use the SME Paisa Associate app as an Associate Partner ("you").
By ticking "I agree to the Terms & Conditions" and creating your account, you accept these terms. If you do not agree, please do not create an account.
Some words used here:
- Case - a business owner (customer) you add in the app because they need a loan.
- Lender - the bank or finance company that gives the loan.
- Sanctioned - the lender has approved the loan.
- Disbursed - the lender has sent the loan money to the customer.
- Commission - the money you earn on a disbursed case.
Who can join
To become an Associate Partner you must:
- Be at least 18 years old and live in India.
- Have your own Aadhaar, PAN and a mobile number in your name.
- Have a savings or current bank account in your own name.
- Have a working email address.
One person can have only one Associate account. You cannot open an account for someone else or let anyone else use yours.
Sign-up and verification
When you sign up, we check your identity and payment details:
- Aadhaar - through DigiLocker, the Government of India's document wallet, with your consent.
- PAN - to confirm your name and for TDS.
- Bank account - so your commission goes to the right account.
- Mobile number and email - to reach you and send you updates.
All details you give must be true, complete and your own. If any detail is false, we can stop your sign-up or block your account.
We use trusted verification partners for these checks. They get only the details needed for the check.
Your role as a partner
You are an independent partner. You are not an employee, agent or representative of SME Paisa or of any lender. Nothing in these terms makes you one.
Your work is to:
- Find business owners who need a loan.
- Add them as a case in the app, with their permission.
- Keep in touch with your customer so they reply to our team on time.
You do not need to collect documents. Our Operations team asks the customer for documents directly by email.
You are free to choose your own working hours and methods, as long as you follow these terms and the law.
Adding cases
Before you add a customer, you must tell them that their details will be shared with SME Paisa and lenders for their loan, and get their permission.
Case details must be correct. Please check them carefully before you submit:
- A case cannot be edited after it is submitted. If something is wrong, raise a ticket and our team will help.
- The same customer can be added again later, for example for a new loan.
- A case usually takes about 15-20 days from submission to disbursement. This is only a guide, not a promise. The lender's process decides the real time.
Commission
You earn commission only when the loan on your case is Disbursed. A Sanctioned loan that is never disbursed earns no commission.
Your commission is 30% to 50% of the net profit SME Paisa makes on that case, depending upon the case. Net profit is what SME Paisa earns on the case after the costs of that case.
The amount for each case is shown in the case details and in Profile -> Earnings & Commission.
Commission is paid only for cases you added in the app under your own account.
Payment
- We pay your commission within 7 days after the loan is disbursed.
- It is paid only to the bank account verified at sign-up (or a new account updated by our team after checks).
- When it is paid, the case status changes to "Associate Revenue Shared".
- If a payment is late or the amount looks wrong, raise a ticket under "Commission & Payout" within 30 days.
If we pay you more than you should get by mistake, we can adjust the extra amount from your next payments, after telling you.
TDS and taxes
As the law requires, we cut TDS (Tax Deducted at Source) from your commission and deposit it with the government against your PAN. The rate is usually 2% and can be up to 10%, as the law applies to you. The exact TDS for each payment is shown in that case.
TDS you pay shows in your Form 26AS. You can claim it when you file your income tax return (ITR).
You are responsible for your own income tax and any other tax that applies to your income.
Prohibited Activities
To protect customers, our partners, and the program, the following activities are strictly prohibited:
- Take any fee, money or gift from a customer for a loan.
- Promise a customer that their loan will be approved, or promise any rate or amount.
- Say that you work for SME Paisa or for a bank.
- Add fake cases, or add a customer without their permission.
- Give false information or forged documents, or help anyone do so.
- Share or sell customer details, or use them for anything other than their loan.
- Use SME Paisa's name or logo in ads or messages without our written permission.
- Send spam calls, messages or emails in SME Paisa's name.
- Try to misuse, copy or break into the app.
Customer data
Customer details you see or add are confidential. Use them only to help that customer get a loan through SME Paisa.
Do not keep copies of customer documents. If a customer asks you to stop, tell our team through a ticket.
You must follow the Digital Personal Data Protection Act, 2023 and other data laws of India when you handle customer details.
Your data and privacy
We collect: your name, mobile number, email, address, PAN, bank account and IFSC, the last 4 digits of your Aadhaar, and how you use the app.
- We keep only the last 4 digits of your Aadhaar, never the full number.
- Your PAN and bank account number are stored encrypted (locked with a secret key).
- Only our team, and only when needed for your account or payments, can see your details.
- We share your details only with verification partners, with lenders when needed for a case, or when the law requires it.
- We never sell your data.
You can ask to see or correct your details by raising a ticket. You can delete your account yourself (see "Deleting your account" below). Some records (for example, payment and tax records) must be kept for the time the law requires, even after your account is deleted.
Account security
- Keep your password and the codes we send you secret. Never share them, even with our team.
- You are responsible for everything done from your account.
- If you think someone else is using your account, change your password and raise a ticket at once.
- When you reset your password, you are signed out on all your devices.
Changing your details
You cannot change your mobile number, email, address or bank account in the app right now. Raise a ticket with the new details. Our team will check and update them.
Blocking and closing an account
We may block or close your account if you break these terms, give false details, harm customers, or if the law requires it. Where possible, we will tell you the reason.
While your account is blocked, you cannot sign in or add cases, and your open cases are paused.
You can stop being a partner at any time by deleting your account (see "Deleting your account" below). Commission already earned on disbursed cases will still be paid as per these terms, unless the account was closed for fraud or misuse.
If you think your account was blocked by mistake, write to connect@smepaisa.com.
Deleting your account
You can delete your account at any time: in the app (Profile -> Profile details -> ⋮ -> Delete my account) or with the form at associate.smepaisa.com/delete-account. We confirm it is you with a code sent to your registered email.
- Your account becomes inactive and you are signed out at once.
- Our team deletes it within 7 days. If you sign in again before that, the request is cancelled.
- If you were never paid commission, all your data and cases are deleted.
- If you were paid commission, your disbursed cases and your encrypted PAN are kept without your name, only as long as tax law (TDS) requires. Everything else is erased.
- A deleted account cannot be restored, and the same PAN cannot sign up again without contacting our team.
Limits of responsibility
- SME Paisa is not responsible for any decision, delay or condition set by a lender.
- We try to keep the app working at all times, but it may sometimes be slow or unavailable, for example during updates.
- We are not responsible for losses caused by wrong details you gave, or by someone using your password.
- Our total responsibility to you for any claim is limited to the commission due to you on the cases involved.
App and brand
The app, its content, and the SME Paisa name and logo belong to SME Paisa. You may use the app only for your work as a partner.
Changes to these terms
We may update these terms from time to time, for example when the law or our program changes. We will tell you about important changes in the app or by email before they apply.
If you keep using the app after the changes apply, you accept the new terms. If you do not agree, you can close your account.
Help and complaints
For any question or problem, raise a ticket in the app (Profile -> Raise a Ticket). Our team will reply to you.
You can also write to us at connect@smepaisa.com.
Governing law and jurisdiction
These terms follow the laws of India. Any dispute will first be attempted to be resolved amicably through mutual discussions.
In the event of any legal dispute, data dispute, breach of terms, claim, or controversy arising out of or in connection with these terms, customer data, or the use of the app, the competent courts located in District Gautam Buddha Nagar (Uttar Pradesh, India) shall have exclusive jurisdiction.
If any part of these terms is found invalid, the rest still applies.
